I think the decision was fair. They had not been living as a married couple over that entire period and it seemed a done deal they were over....they were just too lazy to file for divorce. Now if they had kept getting back together and breaking up, etc., I think she would have got far more.

it said she got everything after the split! then wanted half of the winnings, so she wants more than half of everything! I hope he pys the $10k before taxes. she can cover her own tax liablilty. he should have also demanded half of everthing that she took when they split.

I guess thats why you shouldnt be too cheap and not just pay for the paper work.

Yet, THRIFTY, this situation could be viewed for a remaining positive. Assuming Jose received the annuity payouts ... he still positively receives over apx. Net $37.6K/year for the next four years (after paying his wife, at the time of the win claim, the $10K/year). Then, he'll happily return to receiving the apx. Net $47.6K/year he has become accustomed to.

Regardless, if an adult has a legal document that reads something undesirable, then cancel/replace it with a legal document that reads something desirable (even if that long process means paying more in annual: income taxes, dental, health, life insurance, housing, food, utilities, entertainment, etc).

Magic 007, it appears to be the latter. As the possibly fair $50,000 judgment award [that's $10,000 -- non-taxed again by Fed and State, paid five times annually to his wife during the time of win and claim) is 2.5% of the full advertised $2,000,000 annuitized jackpot win.

A man who won $2 million in the Hoosier Lottery while separated from his wife has to give her only 2.5 percent of the winnings, the Indiana Court of Appeals ruled Wednesday.
