They must have consulted a tax lawyer who advised them to claim together rather than one person to claim and write a personal check to his brother at which point it would be considered a gift. The brothers can easily claim they are in a lottery pool together and IRS would just have to accept it. I would give my brother half even if we have no such agreement. He's a good man.

I hope they can prove they promised to share any jackpot. The IRS doesn't take kindly to losing out on a gift tax which, the last time I looked, was 55%. And payable by the giver.

Otherwise, good for you, bro!

I would like to think my brother would share with me if he won. Now if I won, we would have to come to some kind of agreement. I would keep 99% and he can have 1%.

Well, dpoly1, if you had made such a promise, years ago, to share any 1st or 2nd prize wins with your siblings, them not speaking to you would probably be a reasonable response to them (unless they had the written version of your promise, signed by you) if they asked you why you didn't follow through with your years-old promise to share.

Eric had picked the five numbers 7, 14, 21, 24 and 41 correctly but missed the Powerball itself, according to the Oregon Lottery. He played the same numbers he has played for the past 20 years.

A Bend, Oregon, man who won $1 million with a Powerball ticket last month decided to share the wealth in a gesture of brotherly love.

Eric Hale, 45, split the spoils 50-50 with his younger brother, Quinn Hale, of Yakima, Washington, on Thursday in Salem.
