Had a feeling the prosecutor was going to dismiss the charges on the mother as it was a long shot to begin with. They will grasp at straws in order to get anything to stick.

And how has that changed since the day they arrested her without any evidence that she had committed a crime?

Charges against the other two will most likely be dropped as well.

Considering that the mother was charged based on an allegation that she brought the daughter $20 to pay for the ticket I don't see how the prosecution can present an argument that the ticket was stolen, so the charges of theft probably shoul... [ More ]

Maybe, but there is evidence on the other two individuals. Although, from the beginning locking up her merely trusting mother, I thought, was rather cruel (she'll probably never recover from those anxieties).

If the State does not have enough evidence to prosecute then dismissal is the only choice left. Saves the tax- payers money.

Charges have been dismissed against one of three people charged with fraudulently claiming a lottery ticket prize.

District Judge David Lester on Monday dismissed a charge of aiding and abetting theft of a lottery ticket or share against Sally Bosler. His ruling came after an oral motion from the state requesting the dismissal because, prosecutors said, insufficient evidence now exists to convict Bosler.
