Is there precedent for Plaintiff to prevail? Unlikely. Birthdays are not unique and are simply numbers on a calendar.<br /><br />3. Could someone sue you for inspiration/ideas in other areas...like unique books, scripts, etc. and likely survive a motion to dismiss. YES . It is dumb if you give a press conference and don&#x27;t have to. I thought what I said and meant was pretty obvious.<br /><br />As far as being selfish, I meant it in the sense of what some other people would think. If I give someone more than that then I will owe gift tax. I think that the tax rate for gifts above $14,000 is 40%.
