There has NEVER been a case here in NY where somebody has won an annuity but was able to change the prize to cash. NEVER.

The FAQ does say FEDERAL legislation... Federal legislation overrides state legislation, even in New York.

The jackpots of multi-state lotteries are pooled, so what you can do in one state should be able to be done in another state when it comes to Mega Millions' jackpot payout choice.Lesser prizes are the responsibility of the individual states, however.

Here in NY, for instance, NY Lotto players who hit on a ticket with 26 ANNUAL PAYMENTS are stuck with the annuity. I don't know yet if it will also apply to Mega Millions here.

From the FAQ (a list of Frequently-Asked Questions) on the Big Game site:Q. After I buy a ticket, can it be changed from annuity to cash option?A. Federal legislation states that if you are a jackpot prize winner but did not choose the cash option at the time of purchase AND you claim your prize within sixty (60) days of the drawing, you will have one last chance to choose the cash option. If you choose the cash option at the time of purchase you cannot change to annuity.

If the ticket doesn't say one or the other, the choice is still up to you. If it says annuity you PROBABLY can change it to lump sum within 60 days after you win.

Anyone know if you can get the lump sum payout if you forgot to mark it on the card
