I know that this is technically not a lottery question, it's about PCH Sweepstakes bankruptcy .
A mortgagee doesn't even have to be current on their mortgage. If the borrower is current, the bank wouldn't initiate a foreclosure. Why would they? They don't want the house. They want the principle and interest payments.
Bankruptcy protects the borrower by putting a bankruptcy court between the borrower and their creditors. As long as a judge is between the bank and the borrower, the bank can't foreclose on the home.
After the bankruptcy is filed, the court will require the borrower

He says do not sign it. I think signing it with some bs comment would be hilarious to watch since the delay would be serious and likely end up in court.
If he goes into a lottery meeting where there is a dispute and litigation is possible, he said he brings a litigation attorney with him. Smart move. So obviously an established litigator known and barred in that state.

I would definitely choose another attorney. This is first year law school info he should know. Of course he recommends a blind trust...so he can control your investments and you have no input. I know some winners may want this but it is potentially dangerous with very unsophisticated winners. It is time consuming and court approval can sometimes be needed to undue both blind trusts and irrevocable trusts.
