A pool might be smart enough to have an agreement that includes a prohibition against members playing the pool's number on their own, as that would dilute the pool's winnings in the unlikely event they win a jackpot.
Absent such a clause there's no certainty how a ruling would go in the event of a lawsuit, but if a member reduced the pool's winnings by playing the same numbers I think there's a pretty good chance that there would be a lawsuit. You don't need a good argument to file the lawsui

The Flaw With Pick 3

The flaw in Pick 3 is still a fact. That is, a frequent event is going to happen, as it always has and always will, and that is all three numbers will be all even or all odd, no double or triple. I like this event because I only have to box 10 numbers if I'm betting on odd, or 10 if betting on even.

What are you referring to, when say 'You can use prior to check'?,Do you mean Previous data? , how do you ascertain that the previous or current crunched data is a Prior? say my current draw is 123 after 20 draws, what data size are analysing to establish your prior?
