No I am actually not conflating.
You missed something else in that IRS bulletin.
It said that tax is on the gross amount which implies that foreigners don't get to deduct losses!
Meaning if they spend 100k and win 50k they have to pay taxes on the 50k even though they lost 50k.
I believe the state of Hawaii does this to their residents too... no deducting losses.
Anyway I hope everyone who is reading this is now convinced to get a tax attorney if they get the big jackpot.
