I guess I'm not doing a very good job of explaining this. No, it does not have to be unanimous. One person can take the cash, one person can take the annuity. I'm guessing that you might think that the lottery already has all of the money in the annuity amount. It does not. The annuity is created with future interest earnings. The cash value goes up with sales (27.6305% to be exact). Then, they calculate what the annuity value is based on that cash prize and current interest rates. If interest rates go up, the sum total of annuity payments goes up. If interest rates go down, the sum total of annuity payments goes down.

@ David King I've pondered the annuity vs lump sum debate as well. Ultimately, the lump sum gives you greater flexibility, and more scope to achieve higher returns than the annuity, and faster.
