WARNING: NY King Kong scratch
The only games I play are Powerball, Wild Card 2 and Pick 3 and every once in a while I'll pick up a scratch-off. I think some of the scratch-offs are annuity only, but I don't play them that often. SO I guess I am on the side of Cash. =)

Most people on this board say cash is the only way, but in many ways I agree with Iesha. Although I would try to make my own decisions, my past experience with financial planners has been very negative, so it would be hard for me to choose the right person to invest my money. Although logic would tell me not to take the annuity, sometimes I wonder if knowing you'll have that big check every year gives people peace of mind. Sure you can definitely make more with the cash option as you invest in

Iesha, the annuity payments only increase if you won the Powerball jackpot, which is not likely to get to $500 million due to its share the wealth feature. Mega Millions still pays only an equal amount each year, without adjusting for inflation.

$320K? That's good money, especially when I'll be getting the same amount next year. Just put $100K per year from that into CD's and bonds, and I'll be set even past the 25 years. That's a good prize annuity or not. But then again, the odds are pretty high so what's the point of complaining. You won't be winning it.

It's not quite the same CASH. Because even if you win a million dollars and it is annuity you still have money coming in. People who are scammed lose money, they don't gain any.

She was wrong to choose annuity. Back in 1997 the games with cash options required players to make the choice when they bought their ticket. The 60-day rule (adopted by all US lotteries except NY, TX, and MA Megabucks) was signed into law by President Clinton in 1998.

OH Lot O'Play v PA Unlucky for Life
Both games create instant winners. LoP, among other things, has the cash value at exactly 50% of the annuity instead of a floating percentage. UfL does not have a cash option.

She could've reported it as short-term capital gain with a basis of 0, which will be taxed the same as ordinary income. She had already received 3 or 4 annual payments, and then she received a financial settlement from this firm for the present value of the remaining payments less some fee to the firm. It sounds like a fair deal with the funding firm..she received $ 7.1M when the remaining annuity was probably around $ 15 M to $ 16 M.
