Ownership of $1M winning lottery ticket in question
I think that what the store's policy says or doesn't say about what happens with unsold tickets may be the deciding factor in the case. Once it was refused by the customer the ticket became merchandise that was owned by the store, and it's a safe assumption that the store wanted to sell that piece of merchandise.
