There's a really simple solution that will prevent you from ever finding yourself in this sort of position: don't agree to a bad contract. If a contract is bad enough it will be held to be invalid if it's challenged, but the government has no business protecting adults from every chance to make a poor decision that comes along. The contract (which in this case would have to be argued as an oral contract) is simply this: Buy the person a ticket with the money they gave you. That's it. The supposed contract was fulfilled. There is no obligation for the person buying the tickets to not buy a ticket with the same numbers. They have every right to buy a ticket with the same numbers. You own the ticket, not the numbers on the ticket.

I just went back into my post to delete 1/2 of it. Too late! (got a knock at the door) I just read the other posts again and I don't want to get into a battle about contracts. I think some people are going way overboard with this whole idea. I can almost guarantee that no court would rule that this was a legal contract. People make promises to each other all the time and can't prove them.

You clearly had a contract with your coworker to split the cost and split any winnings, and you clearly agreed to buy the ticket on their behalf and be paid later. You clearly bought the ticket with the intent that you would be co-owners with equal shares. At that point the coworker owns half of the ticket.
